The judge noted that while the number of Venezuelans seeking to return is small, he would not let them 'languish in the solution-less mire' proposed by the government.

Background on the Alien Enemies Act
The Alien Enemies Act was invoked by President Trump last year to summarily remove Venezuelans accused of being members of the gang Tren de Aragua. However, a class of 137 Venezuelans challenged their removals in court, arguing that they were denied due process. The judge had previously determined that their removals were in defiance of an order requiring the Department of Homeland Security to turn around planes bound for a Salvadoran prison.

Government's Response Criticized
The government's responses to the court's requests for steps to facilitate hearings for the Venezuelan migrants were deemed inadequate by Judge Boasberg. He noted that the government essentially told the court 'to pound sand,' leading him to order them to facilitate the return of those who desire it.

Implications and Next Steps
The judge's order does not apply to those currently remaining in Venezuela, citing ongoing tensions between the U.S. and Venezuelan governments following the removal of former President Nicolas Maduro last month. The plaintiffs can pursue additional legal claims from overseas, while others will be taken into immigration custody upon their arrival.

The judge's decision marks a significant step towards accountability for the Trump administration's actions in deporting Venezuelans under the Alien Enemies Act.
